Redevelopment -Norwich

Jackson Purdue Lever is pleased to have contributed to the successful appeal outcome for a national developer client, helping to bring forward the redevelopment of a Norwich site for a new large-format food store.

The planning application was subject to detailed scrutiny throughout the process. Objections were raised by national supermarket operators and independent food store businesses in Norfolk, with the retail planning case reviewed closely on behalf of the local planning authority. Although officers had recommended approval, the application was refused by the planning committee. The refusal reasons related to the loss of an existing community facility, the removal of trees and concerns that the proposals did not sufficiently promote sustainable travel.

Following the submission of comprehensive statements of case, the local planning authority confirmed that it would not defend the stated reasons for refusal. The Inquiry therefore focused on representations from third parties, including concerns around the future of the existing bowling facility and the suitability of the site’s location.

In allowing the appeal, the Inspector weighed the issues relating to the community use, trees and highways matters against the fallback position available on the site. This fallback position was significant, as the existing facility could be converted to retail use without the need for planning permission under recent changes to the Use Classes Order.

The appeal decision also acknowledged the wider advantages of the scheme, including improved accessibility, better pedestrian and cycle links, new employment opportunities and investment in local retail provision.
